Youth sentenced for Dec. 3 shooting

The youth involved in the shooting incident on 110th Street Dec. 3 was handed a lengthy sentence Wednesday in North Battleford Provincial Court.

The individual, who cannot be named under the Youth Criminal Justice Act, was sentenced for intentionally discharging a firearm being reckless to whether there were people inside, possession of a stolen firearm, resisting arrest by running away, carrying a firearm for a purpose dangerous to the public peace and also breaking and entering. The latter was in connection to a break-in at a farm where a number of rifles were stolen.

He received a sentence of 16 months closed custody and eight months supervision in the community for those charges. He also received an additional nine months probation to follow, under several conditions.

The youth must also serve 30 days concurrent and 15 days supervision for an unlawfully at large charge. 

In addition, the youth has been hit with a two-year firearms prohibition, a mandatory lifetime ban on prohibited weapons and an order was made for DNA. He must also make restitution of $1,200.

The sentence runs consecutively to a sentence the youth is currently serving for an incident in Glaslyn in which a house was burned down. His sentence in connection to that incident was nine months — six in open custody and three in the community.

With the latest sentence handed down by Judge Dan O’Hanlon, the total sentence amounts to 22 months of actual custody plus another 11 months in community supervision, followed by nine months probation. The 33 months of custody and supervision is just three months less than the maximum allowable for a youth in Canada.

The incident on 110th Street and 8th Avenue, which happened in the morning hours, shocked North Battleford residents. In imposing sentence Wednesday, Judge O’Hanlon said the incident “traumatized the community.”
