Accused in Estevan homicide appears in court

Accused was remanded into custody, and will be back in court May 14.

ESTEVAN — The man charged in connection with a homicide in Estevan made his first appearance in Estevan Provincial Court on May 12.

Prince Albert's Evan Dennis Isbister, age 36, has been charged with murder in the death of 60-year-old Todd Isbister. Evan Isbister was remanded into custody and he will make a video appearance May 14 in Carlyle Provincial Court.

Judge Mitch Miller asked Crown prosecutor Travis Avery if the murder charge would be particularized further. Avery said it would be first or second-degree murder, but won't be specified immediately. The Crown is opposed to Evan Isbister's release.

Miller then told Isbister that if he wants to be released on bail, a hearing would have to occur before a Court of King's Bench justice. Isbister is entitled to have Legal Aid assist him or he can hire a private lawyer.

Legal Aid attorney Joelle Graham said she anticipates she won't be representing him. She asked for the adjournment for Carlyle so Legal Aid can receive disclosure. Legal Aid will be paying for a private lawyer to assist him.

Background: In a news release, the Estevan Police Service said it is investigating a sudden death that has been deemed a homicide.

The EPS says that at approximately 8:46 p.m. on May 10, officers were dispatched to a residence in the 1400-block of First Street. The caller reported an assault taking place on an adult.

When the EPS arrived, they located three men in the residence. The EPS said two were arrested without incident and transported to the police station. Estevan EMS responded to the scene to care for the victim and transported him to St. Joseph’s Hospital for treatment. He died from his injuries a short time later.

Detectives with the EPS Criminal Investigations Division have been assigned to lead the investigation and will be supported by the EPS Forensic Identification Unit.

One of the arrested men was cleared of any wrongdoing and was subsequently released from custody. The other man arrested was Isbister.

The victim and accused were known to each other and next of kin have been notified of the death.

The EPS continues to investigate.
