A Yorkton man awaiting trial on marijuana trafficking charges is back in jail for possession of hydromorphone and breaching his bail conditions.

Michael Winter was picked up November 18 on the new charges and appeared in Yorkton court the following day when he claimed an RCMP officer planted the drugs on him. The Crown opposed his release and he consented to his remand until November 24.

In that appearance by video, yesterday, Winter’s lawyer, Sharon Fox sought leave to withdraw as counsel for the defence because his recent arrest derailed an application before the Court of Queen’s Bench. Prosecutor David Rusnak argued that Fox’s withdrawal at this late date would be problematic as Winter’s first trial date is fast approaching on January 6 and involves other co-accused persons.

Winter told the court he has an appointment to apply for legal aid on December 1 and judge Ross Green granted Fox’s leave. Winter consented to his own remand until he has had a chance to speak with legal aid. A next appearance was set for December 2 by video.

Winter faces a total of more than 30 charges under the Controlled Drugs and Substances Act related to multiple arrests during the period of September 2014 to January 2015.
