Dubuc man jailed after domestic altercation

A 51-year-old Dubuc man will spend the next three months in custody following an incident in which he held his wife captive at knife-point and threatened to kill her.

Esterhazy RCMP arrested Simon Naylor April 5 after the detachment received a complaint of a domestic altercation.

The accused appeared in Yorkton Court the next day on charges of uttering threats to cause death or bodily harm, possession of a weapon with intent to commit an offence, and forcible confinement.

Judge Patrick Koskie ordered a Bail Verification Report and scheduled another hearing on April 9.

On the morning of the ninth, legal aid solicitor Ransiri Fernando argued for his release on the basis that Naylor had spoken to his father, who said he could stay with him and that the accused would abide by conditions including getting into treatment and having no contact with the victim.

Prosecutor Barrie Stricker continued to oppose Naylor’s release pointing to a very long criminal record that included violence, drugs, breach of recognizance and, most importantly, a previous conviction for uttering threats against his wife.

Stricker also said a probation officer had contacted Naylor’s father, who denied his son could stay with him.

Koskie said he was not opposed to releasing the defendant saying Naylor seriously needed to get into treatment calling the man’s addiction “insane.” The judge gave Fernando until 2 p.m. to come up with a plan. In the afternoon, the lawyer returned with news that he had found a detox bed for Naylor, but there was still no place for him to stay until he could get to the facility.

The judge remanded him for another night.

On Friday, Fernando tried again saying that Naylor’s sister was willing to take him in. Stricker was not satisfied, however, saying that the residence had not been vetted by probation services. Again, Koskie held the case over until the afternoon so probation could check it out.

Probation determined that the residence was not suitable and Koskie gave the defence until Monday to come up with a sustainable plan.

Nothing had changed as of Monday. Naylor pleaded guilty and received three months jail time and 12 months of probation with conditions to participate in addictions assessment and treatment, have absolutely no contact with the victim and report as ordered to a probation officer.
