A Yorkton man is going to prison for eight months related to a public altercation at Walmart in April.
Nathan Kayseas pleaded guilty August 8 in Yorkton court to charges of domestic assault, uttering threats to cause death or bodily harm and creating a public disturbance.
In a joint submission between the defence and Crown, prosecutor Darryl Bode described an incident during which Kayseas struck his partner multiple times. When a bystander tried to intervene the defendant told him to "keep your nose out of it or I will shoot you in the face," Bode said.
When police arrived Kayseas was gone and the victim was transported to a shelter.
In asking for eight months imprisonment plus 12 months probation, the prosecutor submitted a criminal record that included convictions for two previous assaults on the same woman.
Defence attorney Richard Yaholnitsky, acting as duty counsel, cited mitigating circumstances that the accused was remorseful, has taken responsibility for his actions and entered an early guilty plea. He called the joint submission "reasonable."
The judge accepted the recommendation, sentencing Kayseas to eight months on the uttering threats charge with six months concurrent on the assault and two months concurrent on the disturbance charge.
Conditions on the subsequent 12 month probation include the statutory conditions plus a requirement to live at an address approved by a probation officer, have no contact with the victims except through a lawyer and to undergo assessment and treatment for anger management.
Kayseas is due back in court in Wadena on August 21 on one charge of aggravated assault. Wadena RCMP allege Kayseas was involved in a fight on the Fishing Lake First Nation, which involved a knife.
