Madsen sentenced for aggravated assault

A Yorkton man has been sentenced to three years and four months in prison after being convicted of aggravated assault. 

Kim Madsen, 32, was charged after an incident at the City Limits Inn (CI) in Yorkton in September 2015 after throwing another man, Dennis Peepeetch, to the floor several times. 

Peepeetch, 42, suffered from a serious spinal condition prior to the incident, and the altercation at the CI left him paralyzed. 

The Crown’s case was based on the notion that Madsen had attacked the much smaller and frailer man with little provocation. Peepeetch’s pre-existing spinal condition made him prone to serious injury. 

The defence argued that Peepeetch had been the instigator of the altercation by spitting in the defendant’s face. The team attempted to raise reasonable doubt that it was the specific incident with the defendant that caused the paralysis.

Judge Patrick Reis announced his decision on Friday morning at the Yorkton Provincial Court. 

He also ordered Madsen to receive alcohol rehabilitation treatment and anger management.

The Crown had requested a five-year sentence. Upon hearing the official sentencing, Peepeetch’s family released sounds of disappointment in the courtroom.
