Thief jailed for 18 months

A 25-year-old Yorkton man is going to jail for 18 months after pleading guilty to break, enter and theft charges in Yorkton court Monday.

According to a joint submission by Crown prosecutor Andy Wyatt and defence attorney Richard Yaholnitsky, on the night of August 10 Randall Ironstand talked his way into a home on Darlington Street by claiming to be a worker from a local hardware store there to do some work.

Once inside the residence, he asked to use the washroom, where he removed two bottles of cologne then left saying he would have to come back to complete the work. When the 17-year-old girl at the home realized what had happened, she called police.

Wyatt said the girl was very shaken up by the incident.

While RCMP were en route, the detachment received more complaints from the neighbourhood, that a man had broken into a garage and a car. When police apprehended Ironstand, they found him in possession of the items from the home and some other minor items from the garage.

In asking for 18 months incarceration, Wyatt cited Ironstand's lengthy criminal record of 66 convictions including a sexual assault from October 2012 for which he served six months and was on probation for on the date of the August 10 crimes.

Wyatt said given the record, any criminal behaviour on Ironstand's part warranted escalating penalties under the principles of deterrence and denunciation.

Yaholnitsky given his client's early guilty plea, the sentence was a "reasonable joint submission."

On his own behalf, Ironstand told Judge E.S. Bobowski that he was an alcoholic and had been naïve to think he could get away with drinking that weekend without consequence. He said he wanted to get treatment for his addiction and would attempt to do so while in custody and when he is eventually released.

In exchange for guilty pleas on two counts of break and enter, two counts of theft and one count of breach of probation, the Crown dropped two counts of possession of the proceeds of crime, two counts of breach and one count of mischief.
