Mental assessment ordered in second-degree murder case

An assessment order has been made into the mental condition of a man charged with second-degree murder.

Joshua Tucker appeared in North Battleford Provincial Court again Monday morning by closed-circuit TV. The second-degree murder charge stems from an incident in the Cochin area May 31.

Monday, the Crown applied under section 671.11 of the criminal code, asking the judge to order an assessment of the mental condition of Tucker.

Under this provision of the code, this assessment is to determine whether the accused was, at the time of the commission of the alleged offence, suffering from a mental disorder so as to be exempt from criminal responsibility by virtue of subsection 16(1) of the criminal code.

The code states: “No person is criminally responsible for an act committed or an omission made while suffering from a mental disorder that rendered the person incapable of appreciating the nature and quality of the act or omission or of knowing that it was wrong.”

Judge Bruce Bauer agreed to make the order. The assessment is expected to take place in the coming weeks.

Tucker remains in custody. His next court date has been scheduled for July 23 at 11 a.m. by CCTV in North Battleford Provincial Court.
