The third accused in the Sept. 1 shooting case has been sentenced to jail time.
Valen Nicotine entered guilty pleas to aggravated assault and use of a firearm in commission of an offence in provincial court Monday.
For his role in the shooting, Nicotine received two years on the aggravated assault charge and one year for the firearm charge, the two running consecutively. He receives considerable remand credit, however, of 14.5 months. Included in the sentence is a DNA order, a 10-year firearms prohibition and a forfeiture order.
Nicotine is the last of three accused in the shooting to be dealt with. The incident took place at 6:49 a.m. on Diefenbaker Drive. According to the facts presented in court, Nicotine, as well as Justin Fineday and a youth, ended up in an altercation with a passersby who was among three people walking on the street.
They drove up to the victim, who was shot twice by Fineday. The vehicle then took off and the gun used in the offence, a sawed-off .22 rifle, was later deposited in the shrubs of one of the men's relatives.
The three-year sentence for Nicotine was agreed to by Crown and defence in a joint submission in court Monday.
The others charged have all been sentenced. Fineday received 11 years for his role in the Sept. 1 shooting as well as an earlier incident in May.
The youth accused was sentenced in November to 160 days in open custody and 80 days of community supervision for a total 240 days, after entering a guilty plea to accessory after the fact in the case.
However, the youth is back in custody. He appeared in provincial court Monday charged with possession of bear spray, stemming from an incident June 21. The youth is due back in court Wednesday.
