Sentence handed down in domestic assault

A jail sentence has been handed down in a case of aggravated assault involving a common-law couple. Michael Lavallee was sentenced to 10 months in custody and another nine months probation in provincial court Wednesday in North Battleford.

Michael Lavallee was sentenced to 10 months in custody and another nine months probation in provincial court Wednesday in North Battleford.

He had earlier pled guilty to aggravated assault, assault and breach of undertaking charges. The aggravated assault guilty plea is in connection to an April 3, 2010 incident where the Crown alleged Lavallee struck, kicked and punched his common-law wife. The victim was taken to both Battlefords Union Hospital and Royal University Hospital suffering bruises and a fractured rib.

Lavallee was charged with assault following less serious incidents July 3 and July 5 where he was alleged to have kicked and punched his victim, but no serious injuries resulted from that.

He was arrested following the July 5 incident and was later released on conditions, including a no-alcohol clause. He was returned to custody after he was stopped in Saskatoon by police and found with two cases of alcohol. That led to the breach of undertaking charge, with his bail being revoked. Lavallee has been in custody since Aug. 19.

Lavallee has been credited for 150 days one-for-one credit for time served already in custody, meaning he will have about five months of jail time left. As well, he will be under strict conditions during the probation period. The conditions include, among others, a no-contact order, curfew, an alcohol ban, addictions assessment and treatment, and a weapons ban.
