Man accused of possessing child porn released on conditions

MOOSEJAWTODAY.COM — Ashton Weber, who has been accused of possessing child exploitation materials, has been released on several conditions and will be expected to reappear in court in early June.

The 22-year-old man made his first appearance in Moose Jaw Provincial Court on May 9, after police — in partnership with the Saskatchewan Internet Child Exploitation (ICE) Unit and the RCMP Digital Forensic Services — arrested him a day earlier while executing a search warrant at a home on the 300 block of Lillooet Street West.

The Crown agreed to Weber’s release, while Judge Brian Hendrickson imposed more than a dozen conditions that he must follow. 

Those conditions include appearing in court when required to do so, maintaining a residence and not changing that address, having no contact with anyone under age 16 unless with the consent and presence of a parent/guardian who is aware of the charges and the conditions, not visiting a park or swimming pool, not being at or near a schoolyard, playground, daycare or community centre and not having a job or volunteer position that deals with anyone under 16.

Furthermore, he cannot possess or use any device capable of storing data in a digital format like computers, cellphones, cameras or anything that can access the internet, although he can use a non-internet-connected telephone or computer for work if the employer controls both devices on the premises.  

Moreover, he can use a phone or computer for educational purposes if the educational institution owns and controls those devices and he uses those devices on the organization’s property with consent. 

Also, he cannot use or access the internet, must provide passwords to his computers or devices, cannot possess or access pornography, must present himself at the door when a peace officer asks, and must allow the peace officer to search his person, house or vehicle no more than three times a month. 

Weber will return to court on Thursday, June 6.
